Mackinaw Getaways Rental Agreement
- CHECK IN TIME is after 3pm (EST)
- CHECK OUT TIME is by 10am (EST)
- This is a NON-SMOKING cabin. Evidence of smoking will result in loss of deposit.
- Pets are permitted in some cabins with prior approval and fees.
- TERMS OF USE. Guest is authorized to use the property solely as a private temporary dwelling pursuant to the terms set forth herein. Guest agrees to use and maintain the property in a careful, safe, sanitary, and proper manner. Guest agrees not to use or occupy the property for any unlawful, immoral, or improper purpose or for any purpose which may or will be detrimental to the reputation of the property or which causes annoyance to or disturbs the neighbors. Owner agrees to provide a safe and habitable dwelling, to comply with state and local housing codes, and to maintain the dwelling, grounds, appliances, equipment and utilities in reasonable working order.
- DAMAGE/RESERVATION DEPOSIT. The total rental amount due may include a security/damage deposit. The damage deposit is fully refundable within (14) fourteen days of departure, providing the following provisions are met: agreement may require a damage deposit. The deposit is NOT applied to the rent; however, it is fully refundable within 14 days of departure, provided the following provisions are met:
- No damage is done to the cabin, its contents or grounds, beyond normal wear and tear;
- All debris and rubbish are properly bagged and placed in the trash container provided; and
- All keys are returned to the lockbox and the cabin is locked and secured;
- No linens are lost or damaged; and
- Dishes, pots, pans, etc. are washed, dried and properly stored
- PAYMENT. An advance payment equal to 50% of the total rental amount is required immediately to book the reservation. The balance is due (30) thirty days prior to arrival.
- CANCELLATIONS. Bookings canceled at least 60 days before the start of the stay will receive a full refund. Changes that result in a shortened stay within 60 days of arrival do not warrant any refund of rent or deposit.
- MAXIMUM OCCUPANCY. Each cottage has a specific occupancy. An additional charge of $20 per person per night for guests in addition to the posted occupancy will assessed.
- CLEANING FEE. A cleaning fee is charged in addition to rental fees.
- LINENS. Linens, bedding and bath towels will be provided but they are not to be taken from the cottage. We recommend that you bring your own beach towels.
- RATE CHANGES. Rates are subject to change annually.
- STORM POLICY/ROAD CONDITIONS. No refunds will be given for weather related problems. Roads are generally well maintained, and we do not refund due to road conditions.
- DO NOT FLUSH anything other than toilet paper. Improper disposal of diapers or feminine products may result in forfeiture of your security deposit.
- WINTER GUESTS. Special requirements for our winter guests:
- Please reduce the thermostat to 60 degrees prior to check out.
- Turn off all baseboard heaters if applicable.
- Leave the kitchen cabinet doors beneath the sink as well as the laundry and bathroom doors OPEN for adequate heat circulation to prevent the pipes from freezing.
- LOSS OR DAMAGE. Guest agrees to indemnify the cabin/cottage owner and/or his agents and representatives from and against all liabilities, damages, and other expenses, including reasonable attorneys’ fees, which may be imposed upon, incurred by, or asserted against property owner and/or his agents and representatives by reason of (a) any failure on the part of Guest to perform or comply with any covenant in this agreement; or (b) any injury to person or loss of or damage to property sustained or occurring on the premises on account of or based upon the act, omission, fault, negligence, or misconduct of any person whomsoever other than owner. Guest shall be liable to owner for any and all damages to buildings, fixtures, and grounds due to misuse and/or neglect or by failure to observe any of the provisions of this agreement.
- USE OF GUEST SUPPLIED RECREATIONAL EQUIPMENT. Some properties include the use of recreational equipment (kayaks, canoes, bikes, etc). In consideration of the risk of injury while using the recreational equipment, and as consideration for the right to use the equipment, I hereby, knowingly and voluntarily enter into this waiver and release of liability and hereby waive any and all rights, claims or causes of action of any kind whatsoever arising out of my use of this equipment, and do hereby release and forever discharge their managers, attorneys, staff, heirs, representatives, predecessors, successors and assigns, for any physical or psychological injury, including but not limited to illness, paralysis, death, damages, economical or emotional loss, that I may suffer as a direct result of my use of the aforementioned equipment.
MACKINAW GETAWAYS is an agent of the Owner with the authority to enter into this Rental Agreement and is not a party to this Rental Agreement. The terms and conditions of this Rental Agreement as finalized will govern. Any exception to the terms of this Rental Agreement must be approved in writing by the Owner.
